More Clarity Regarding the State of Washington’s Phenol Free Law

Upon further investigation and direct communication with the State of Washington,  Consumer Product Regulatory Unit Supervisor, we have been able to clarify several important points of the Phenol Ban in Washington State.

  1.  The law was defined to focus on products manufactured, not shipped after January 1, 2026.  All products manufactured after January 1, 2026, and shipped to Washington State must be Phenol-Free.
  2. When asked if there were any exemptions or labeling options for products that are not in compliance, the answer was simple:  No. This regulation does not allow for labeling options. It is a restriction. If a company wishes to apply for an exemption to the regulation, there is a process for that. It is not a guarantee we will approve it. Please see the attached document about requesting an exemption.  SPWA_Exemption_Process_2404055 (This is the state application for Exemption)  You will notice that thermal paper will not be approved for an exemption, based on the criteria described in the document.
  3. When asked about the increased costs associated with converting from BPA/BPS Free to Phenol Free, the response referrences a program with the State of Washington to allow for financial assistance with this change.   Here is the link to this page:  CLICK HERE
  4. We are waiting on clarification for the concessions for non-compliance.  This information will be updated upon receipt.
